Terms and conditions of use.

Introduction

These general conditions of use (CGU) govern the use of the Musicalee platform, its services, and its functionalities. By accessing or using Musicalee, you agree to be bound by these T&Cs. Please read the following terms carefully before using our platform.

1. Acceptance of the T&Cs

  • By using Musicalee, you acknowledge having read, understood and accepted these T&Cs, as well as our confidentiality policy. If you do not agree to these terms, please do not access or use our Platform.

2. Using Musicalee

  • Musicalee is a free music streaming platform with ads. You can listen to music for free, but advertisements will appear every 10 songs listened to.
  • Users have the option to sign up for a monthly subscription to remove ads from their listening experience.
  • Musicalee organizes a challenge every 3 months where the user with the most likes on all of his/her songs, with a minimum of 1000 likes to be eligible, can win $1000. The winner will be paid in their local currency (at the rate in effect on the date of the last day of the period during which the winner will be declared) by the means mentioned in the FAQs (Part 3: Subscriptions and payments)
    If the minimum of 1000 likes is not reached during the quarter, then the competition will continue and the likes will not be reset, until we have a winner, at the end of one of the quarterly periods mentioned below. As soon as we have a winner, the likes will be reset for the following period:
    The challenge periods are the same every year:
    Period 1: From January 1 to March 31
    Period 2: From April 1 to June 30
    Period 3: From July 1 to September 30
    Period 4: From October 1 to December 31
    If there is no winner over 4 successive periods, i.e. over a period of 12 rolling months, then the $1000 will be distributed among the top 20 artists in the ranking.
  • Music contests allow users to listen to and vote for only one artist at a time. The winner of the competition wins the sum of 160 dollars if they obtain a minimum of 100 votes.
  • The artists are not paid for the streams, but they may receive donations from users. The artists will receive 80% of the amount of donations excluding taxes.
  • Sales of singles and albums earn artists 20% of the amount excluding taxes.
  • The artists will receive 15% of the amounts paid by customers for any other service offered by Musicalee, excluding taxes.

3. User Account

  • To use certain features of Musicalee, you must create a user account. You are responsible for maintaining the confidentiality of your account and login information.
  • You agree to provide accurate, current and complete information when creating your Musicalee account. Any suspicious or fraudulent account may be suspended or terminated.
  • You must not share your Musicalee account with others or access accounts belonging to other users without authorization.

4. User Content

  • You retain all rights to the content you post on Musicalee, but you grant Musicalee a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute and display your content. You guarantee Musicalee the right to use your works and your image for commercial purposes, in order to promote your songs and in order to develop remunerative services as part of the development of the platform.
  • You warrant that your Content respects copyright, trademark, privacy, publicity and other applicable rights or laws.
  • Musicalee reserves the right to delete any content that it considers to be in violation of these T&Cs or applicable law.

5. Intellectual Property

  • Musicalee owns all right, title and interest in and to the Platform, including all associated intellectual property rights.
  • You may not copy, modify, distribute, sell or otherwise exploit any content or intellectual property owned by Musicalee without prior written permission.

6. Modifications of the T&Cs

Musicalee reserves the right to modify, update or replace these T&Cs at any time, without notice. It is your responsibility to consult the T&Cs regularly to stay informed of changes.

7. Reasons of non-payment of earnings

Musicalee reserves the right not to pay the amount due to the winner if:

  • The winner does not provide valid identification within 7 days maximum after the end date of the challenge or competition
  • The winner cheats by creating fake accounts or uses IT solutions such as robots
  • The winner denigrates the platform on all possible communication media
  • The winner does not respect the platform's code of conduct

8. Disclaimer

The Musicalee platform offers a service allowing musicians to showcase their talents and share their music around the world. While we strive to ensure a positive experience for all users, it is important to note that the Musicalee platform takes no responsibility for the use of unpaid instrumental tapes by singers or musicians or the use of non-royalty free images.

Artists on the Musicalee platform are solely responsible for ensuring that they have appropriate rights and permissions for the content they upload, including any instrumental tracks used in their music. This includes obtaining appropriate licenses or permissions for any copyrighted material.

The Musicalee platform strongly encourages artists to respect intellectual property rights and to only use instrumental tapes or images for which they have a legal right of use. Any misuse or violation of copyright is the sole responsibility of the artist, and the Musicalee platform cannot be held responsible for such acts.

Finally, the artists who distribute their songs on the Musicalee platform certify that they are free from any exclusivity contracts with distribution companies, labels and other organizations. Musicalee will not be held responsible in the event of non-compliance by artists with the exclusivity clauses binding them and preventing them from distributing their music on Musicalee without prior agreement from their service providers.
